Privacy Policy
By using the website www.linqia.com (the "Website"), owned and managed by Starfish Community Groups S.L. ('Linqia'), you ('User') accept the following privacy policy (the 'Privacy Policy'), which governs the data processing undertaken through the Website and concerning the services found thereon (the 'Services').
Users are also aware of Linqia's Terms and Conditions governing the Services offered on the Website. In the event of inconsistency between this Privacy Policy and the Terms and Conditions, the Terms and Conditions shall prevail.
Linqia is committed to protecting User's privacy. This Privacy Policy describes how Linqia collects, receives, uses, processes, and shares information concerning the User, including but not limited to User's name, address, email address, or phone number ('Personal Data'). When User registers with Linqia, User's Personal Data and other data will be stored and processed in Spain and in Germany, and this information will be subject to the laws of Spain. In order to use the Services and provide User's Personal Data, User must be of legal age or have User's parent's permission in accordance with applicable law.
How we collect and use User's Personal Data
General
Linqia collects Personal Data when User signs up with Linqia to use the Services and each time User uses the Services.
When User signs up, Linqia asks for User's username, email address, birthday and password or for User's Open Identity. In the future User may be able to add certain optional information to User's profile, such as User's address, home town, gender, biographical information, and personal interests. The Personal Data collected by Linqia by any method will be incorporated in a database called "db.linqia.com", located in Germany. This file is managed by Linqia and will be registered with the Spanish Data Protection Agency. Data requests are mandatory wherever so indicated in the Website. The purpose of the data processing is to allow Linqia to properly perform the Services and to be able to provide User with best and most complete experience possible. During the performance of the Services, Linqia may require the international exchange or transfer of Personal Data solely for the provision of the Services. By entering Personal Data in the Services or by otherwise disclosing Personal Data, User gives explicit consent to data processing described herein and in particular that User's Personal Data may be transferred across international borders to a location outside the country of User's location, always in compliance with applicable law.
Additionally, Linqia may use the data collected for sending commercial communications from Linqia and third party companies that may be of User's interest and which will be clearly identified in the relevant commercial communications. Linqia will process all the data and will send the communications to the User, not transferring the data to any third party.
Linqia guarantees that it will apply the legally required security measures in order to keep User data strictly confidential and will only use the data for the purposes set out in this Privacy Policy.
Linqia automatically receives and records information on its server logs from User's browser, including User's IP address, cookie, and the page User requests.
Use of cookies
Linqia may use cookies on the Services. A cookie is a small file, which often includes an anonymous unique identifier, which is sent to User's browser and stored on User's computer's hard drive.
If User does not wish to have cookies placed on User's computer or wishes to be notified when they are placed, User may set User's browser to reject cookies or notify User of their use. If User rejects all cookies, User will not be able to use those parts of the Services that require User to "sign in".
Linqia uses its own cookies for a number of purposes, including but not limited to, accessing User's information when User "signs in"; keeping track of preferences User specifies while User is using the Services; and displaying the most appropriate advertising banners based on User's activity on the Services.
Linqia permits other companies involved in the provision of the Services (i.e. affiliates, advertisers, etc.) to issue cookies through the Website, subject to their own privacy policies. User may configure User's browser as explained above for Linqia's cookies and shall check those privacy policies from time to time.
How we share User's Personal Data
When User posts a message, User's Linqia username that User is posting under is visible to other users. If User post Personal Data online that is accessible to the public, User understands that this can be accessible to any user of the Internet (except when stated otherwise by Linqia) with all of the relevant consequences (i.e., User may receive unsolicited messages from other parties in return).
Generally, Linqia does not share User's Personal Data with third parties or nonaffiliated companies without User's prior consent except to the Services or in the following circumstances:
- Linqia may be required to disclose personally identifiable information under special circumstances, such as to comply with legal requirements or to exercise its legal rights;
- It may be necessary to share Personal Data in order to investigate, prevent, or take action regarding suspected or actual illegal activities on or through the Services, including but not limited to violations of the Terms and Conditions or infringement of third party intellectual property rights, or as otherwise permitted or required by applicable laws;
- Linqia may share aggregated demographic information with its business partners. This is not linked to any Personal Data that can identify any individual person without the prior consent of that person; and
- In the event Linqia enters into a joint venture or is acquired by or merged with another business entity, we may disclose User's Personal Data to our business partners or new owners.
Editing or deleting User's account information / Exercising User's rights
With regard to any of User's Personal Data provided to Linqia, User shall have the rights of access, correction, deletion and objection regarding its personal data. Such rights may be exercised by notice in writing sent to Linqia's registered address (as shown at the end of this Privacy Policy) or by e-mail sent to privacy@linqia.com. Moreover, the User may unsubscribe to commercial communications received from Linqia by following the instructions included in each communication sent.
User can edit User's Linqia account information at any time and User can delete User's Linqia account at any time from User's account page; however, please note that User's identification, billing and contact information may remain in Linqia's records for some period after the deletion.
Log Files
Each time User accesses the Website, Linqia will save the following data in a log file:
- User's IP address (by which User's computer can be clearly identified),
- The name and IP address of the computer requesting the respective page from the Website,
- The time, status, and amount of the transferred data, as well as the Internet website from which User has reached the requested page of the Website,
- The product and release information from User's Internet browser.
This log file will be stored by Linqia in the standardized "combined" log file format for the Apache Web server. Linqia uses the data from this log file in anonymous form without reference to User's person for statistical purposes. In doing so, Linqia may analyze on which days and at which time the Services are particularly frequented and how much data volume is created on the Website. Furthermore, by using the log file, Linqia can identify defects on the Website, such as defective hyperlinks or program defects or security issues, and thus continually improve the quality of the Website. Linqia does not attribute the website demands stored in the log file to specific individual users. However, Linqia reserves the right to review the log files from the last known IP address of User where Linqia has reasonable cause to believe that User is using Linqia Services in breach of contractual agreements or the applicable legislation. In doing this, Linqia is protecting other Linqia users, the safety of Linqia users' data, as well as the Website and the Services.
Groups
On the Website, Linqia offers the Services to present online communities and groups hosted on other community platforms.
Linqia shows the profile of groups that were either created manually by a group moderator, a private person or that were technically inserted into the Linqia Platform. The group profiles show the URL address and other information about the groups that will be displayed on the Website. These are visible to User and are also visible to non-members of Linqia who access the Website.
Whether a group is public or private will be indicated on the relevant Linqia Profile. Nobody has direct access to any of the groups without first having been accepted by the owner or the group moderator of the group. By joining one of Linqia's groups, User acknowledges and accepts that any of User's Personal Data related with the group will be published thereon.
How we can modify this Privacy Policy
User understands that Linqia is continuously developing the features and the functionality of the Services, the Website, and the related software. Consequently, we also reserve the right to modify this Privacy Policy at any time in our sole discretion. User agrees that such alteration shall be effective upon posting on the Website and User will be bound to any alterations when User uses the Services after such alteration is posted. It is therefore important that User review this Privacy Policy regularly on the Website to ensure that User is updated regarding any alterations. User's sole remedy should User not agree with the altered Privacy Policy shall be to close User's account and to cease using the Services.
